PUBLIC AGREEMENT (OFFER)

for the provision of online educational services using the Buteyko breathing method.
This agreement is an official public offer by Sole Proprietor Oksana Nesterenko, RNOKPP – 2536304943 (hereinafter – the “Provider”), to enter into a contract with any individual who accepts the terms of this offer (hereinafter – the “Customer”) for the provision of services under the conditions set out below.

1. Subject of the Agreement

1.1. The Provider undertakes to provide the Customer with educational services / conduct classes using the Buteyko breathing method, and the Customer undertakes to pay for these services in a timely manner under this Agreement.
1.2.Description of the service: the service is provided online in the form of video conferences (Google Meet, Zoom, etc.) as group or individual classes.
1.3. All services under this Agreement are provided online.
1.4. The services provided by the Provider are educational in nature, are not medical or therapeutic, do not replace consultation with a doctor and are not part of healthcare activities.
1.5. The Customer may select one or several service options.
1.6. The services include one or more of the following formats:
– Basic group course – 5 sessions of the basic course, 1–1.5 hours each according to the schedule + 1 additional session of 1–1.5 hours after 2–3 months.
– Basic individual course – 5 sessions of the basic course, 1 hour each according to the schedule + 1 additional session of 1–1.5 hours after 2–3 months.

– Follow-up practice group – 7 lessons of 1 – 1.5 hours according to the schedule
– Children’s Individual Course (ages 5–15) with a Parent — 5 sessions of the basic course, 1 hour each according to the schedule + 1 additional session of 1–1.5 hours after 2–3 months.
– Children’s Combined Course (ages 5–15) — an adult learns the method in a group, trains the child at home, followed by 2 joint sessions of 1 hour with the child.
– Individual Sessions — from 0.5 to 1 hour.
– Coaching Support — from 5 weeks to 3 months via email correspondence.

– Training in Other Languages with Interpreter — group or individual option, 5 sessions of the basic course, 1–1.5 hours each according to the schedule + 1 additional session of 1–1.5 hours after 2–3 months.

2. Procedure for Concluding the Agreement

2.1. Acceptance of this offer is effected by the Customer making an advance payment for the services to the Provider’s account or through online payment systems.
2.2. The Agreement is considered concluded from the moment the funds are credited to the Provider’s account, including via payment services.

3. Rights and obligations of the parties.

3.1 The Provider undertakes to:
– Deliver high-quality services as specified in the subject of the Agreement according to the schedule.
– Respect the confidentiality of the Customer’s information.
3.2. The Customer undertakes to:
– Provide accurate data for registration and participation.
– Make timely payment before training begins.
– Follow the schedule of classes.

4. Price of Services and Payment Procedure

4.1. The price of services is stated on the website.
4.2. Payment is made as 100% prepayment before the start of the course.

5. Refund procedure

5.1. If the Customer has not attended any class of the course, they are entitled to a full refund for the unused course.
5.2. If the Customer has attended part of the course, they are entitled to a refund for unattended sessions calculated at 1/5 of the total course cost for each of the first five sessions. The sixth session is non-refundable regardless of attendance.
5.3. To receive a refund, the Customer must submit a written request (by email) no later than before the fifth session inclusive. After the start of the fifth session, no refunds are issued.
5.4. If the Customer paid for coaching support but did not use it, the funds are refunded in full within 14 calendar days after a written request. If the Customer has initiated coaching support (sent at least one email and received a reply), the funds are non-refundable.
5.5. If the Customer fails to attend an individual session at the agreed time without notifying at least 24 hours before the session, the funds are non-refundable.
5.6. Refunds are made to the Customer’s account within 14 calendar days after the written request.

6. Force Majeure

6.1. The Parties are released from liability for partial or full non-performance of obligations under this Agreement if such non-performance resulted from force majeure circumstances that arose after the conclusion of the Agreement and could not have been foreseen or prevented, including but not limited to: military actions, mobilization, illness, epidemics, technological accidents, power or internet outages, terrorist acts, natural disasters, etc.

7. Personal data

7.1. The Customer consents to the processing of personal data necessary for the provision of services, in accordance with the Law of Ukraine “On Personal Data Protection.”

8. Final provisions

8.1 This Agreement is a public offer in accordance with Article 633 of the Civil Code of Ukraine. The Agreement is deemed concluded between the Provider and the Customer from the moment of full payment for the services by the Customer. The offer is a legally binding agreement that does not require signing a hard copy.
8.2. All disputes shall be resolved through negotiations or, if necessary, in court.
